4.1. All rights, title, and interest in and to the Services, including all Intellectual Property Rights therein, are and will remain the exclusive property of the Company and its licensors. 4.2. Nothing in this Agreement shall be construed as granting you a right to use any of our Intellectual Property Rights.
5.1. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE SERVICES. 5.2. THE COMPANY'S TOTAL LIABILITY IN ANY MATTER ARISING OUT OF OR RELATED TO THIS AGREEMENT IS LIMITED TO THE GREATER OF (A) US $100 OR (B) THE TOTAL AMOUNT YOU PAID TO THE COMPANY IN THE SIX (6) MONTHS PRECEDING THE INCIDENT GIVING RISE TO THE LIABILITY.
6.1. This Agreement shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions. 6.2. 8.1. Identity and Authentication (a) You are strictly prohibited from impersonating or attempting to impersonate other individuals, entities, or organizations; (b) You may not use another user's account or credentials without explicit authorization; (c) You must immediately notify us of any unauthorized use of your account or any other breach of security; (d) We reserve the right to verify your identity through government-issued identification or other means at any time. 8.2. Brand Protection and Defamation (a) You shall not engage in any activities that damage, disparage, or tarnish the reputation of our Company, other users, or third parties; (b) You are prohibited from making false, misleading, or defamatory statements about any person, entity, or brand; (c) We reserve the right to remove any content that we determine, in our sole discretion, to be harmful to any brand or reputation. 8.3. Prohibited Content You are strictly prohibited from posting, transmitting, or sharing content that: (a) Is illegal, harmful, threatening, abusive, harassing, defamatory, or invasive of privacy; (b) Promotes discrimination, bigotry, racism, hatred, harassment, or harm against any individual or group; (c) Is obscene, pornographic, or contains excessive violence; (d) Contains any malicious code, viruses, or harmful components; (e) Constitutes unauthorized commercial communications or spam. 8.4. Copyright and Intellectual Property Protection (a) You warrant that any content you submit does not infringe upon any third-party intellectual property rights; (b) We comply with the Digital Millennium Copyright Act (DMCA) and will respond to notices of alleged copyright infringement; (c) We maintain the right to remove any content that infringes upon copyrights or other intellectual property rights; (d) Repeat infringers will have their accounts terminated.
9.1. Violation Consequences (a) We reserve the right to investigate and take appropriate legal action against anyone who violates these terms; (b) We may immediately terminate or suspend your account without prior notice for violations; (c) You may be held legally and financially responsible for damages resulting from your violations; (d) We will cooperate with law enforcement authorities in investigating and prosecuting illegal activities. 9.2. Indemnification You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from: (a) Your violation of these terms; (b) Your impersonation of any person or entity; (c) Your violation of any rights of another party; (d) Your misuse of the Services.
10.1. If you believe your copyrighted work has been used in violation of your rights, please submit a written notification to our designated Copyright Agent containing: (a) Identification of the copyrighted work claimed to have been infringed; (b) Identification of the allegedly infringing material; (c) Your contact information; (d) A statement of good faith belief that the use is not authorized; (e) A statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner.
